These Regulations define the terms and conditions for the use of the SWRM Szczecinek Public Bicycle Rental System operating in the City of Szczecinek, operated by Komunikacja Miejska Sp. z o.o. in Szczecinek. The content of the regulations is available free of charge on the website www.rowery.szczecinek.pl, the login page to the www.swrm.szczecinek.pl system and in the SWRM mobile application
2.1 Regulations - these regulations describe the rules and conditions for using the SWRM Szczecinek Public Bicycle Rental System, the scope of rights, duties and responsibilities of the Operator and the Customer. Acceptance of the Regulations and fulfillment of all conditions specified in it, is a necessary required to join and use the SWRM System - Szczecinek City Bike Rental. The Customer concludes a contract with the Operator of the SWRM Szczecinecka Bicycle Rental System at the moment of registration, accepting the Regulations.
2.2. Agreement- agreement between the Customer and the Operator of the SWRM Szczecinek City Bike Rental System, establishing mutual rights and obligations specified in the Regulations. The contract is concluded at the moment of acceptance of the Regulations by the Customer, confirmation of registration in the activation link and payment of a one-off, non-returnable initial fee / deposit during the registration process in the SWRM Szczecinek Bicycle Rental System
2.3. Operator of the SWRM Szczecinek City Bike Rental System- an organizational unit that performs services related to the operation of the SWRM Szczecinecka Bicycle Rental System of Municipal Bicycles is the City Transport Company with o.o. in Szczecinek
2.4. SWRM system of Szczecinek City Bike Rental - 24/7- technical and teleinformatic infrastructure, software, devices and bicycles, serving the maintenance-free service, short-term rental of bicycles, also referred to in the Rules as "Service" and "Rental".
2.5 Client- User of the SWRM Szczecinecka Bicycle Rental System, who registered in the SWRM System, on the website, accepted the Regulations and the Agreement, confirmed the registration with an activation link in the message received at the email address provided during registration and paid the initial fee / deposit of 19, PLN 0.00 (in words: nineteen zlotys and 00/100).
2.6. Service of the SWRM System- technical service of the system, dealing with maintenance, relocation of bicycles in stations and repairs of the SWRM System.
2.7. Customer Service Office of the SWRM System- Hotline providing 24/7 telephone contact with the SWRM System Operator at +48 94 712 88 88, voicemail and electronic mail at the following e-mail address: email@example.com
2.8 System operation area- administrative boundaries of the city of Szczecinek, within which it is allowed to use bicycles of the SWRM System.
2.9 SWRM station– an electronic device for renting and returning bikes by Customers, marked with the symbol of the SWRM System, equipped with a terminal and bicycle stands to which bicycles are returned (parked).
2.10 Terminal– an electronic device for self-rental and return of a bicycle built into the SWRM Station.
2.11 Slot- bicycle parking slot in the form of a specialized handle equipped with electric lock and bicycle safety equipment.
2.12 Customer ID- customer's mobile phone number provided during registration and a 4-digit PIN number assigned by the Customer during the registration process in the SWRM System.
2.13 Login- an individual identifier assigned by the Customer to log in to the Customer's panel in the SWRM System
2.14 Table of Fees- Price list of services and fees of the SWRM System constituting Annex No. 2 to the Regulations, available on the website www.rowery.szczecinek.pl, and in the mobile application.
2.15 Client's account- a personal Client's account in the SWRM System, on which recognition and charges for the use of the SWRM System are carried out in accordance with the Table of Fees.
2.16 Internet payments- quick online payment systems operated by external service providers.
2.17 Initial / deposit fee- one-off, non-refundable, minimum fee of PLN 19 paid by the Customer during registration in the SWRM System, which determines the entitlement to start using the system. The amount is fully available to cover the first rentals.
2.18 Top-up amount- the amount paid by the Customer in the form of prepayment (top-up) to the Customer's personal pre-paid account, fully to be used to cover fees for using the SWRM system in accordance with the Table of Fees.
2.19. Bicycle rental- start using the SWRM bike. Bike rental is described in item VII. Regulations: "Bike rental".
2.20 Returning the bike- ending using the bike at any SWRM Station. The return of the bike is described in item IX. Regulations: "Return of the bike".
2.21 Code lock- Anti-theft cable with combination lock for securing the bicycle during a stop or returning the bike at the station in case of a full station.
2.22 Special Actions- promotional and information campaigns carried out for Clients of the SWRM System during the System's operation, to promote and popularize among residents of Szczecinek
2.23. The operator of the SWRM system– Komunikacja Miejska Ltd. in Szczecinek
2.24 Map of the SWRM System- the area of the city of Szczecinek, on which the stations are located, presented on the website www.rowery.szczecinek.pl, bicycle stations and in the mobile application, within which the SWRM system operates.
2.25 Reservation- a feature that allows the customer to reserve a bicycle remotely and free of charge via the user panel on the website or in the mobile application. The reservation takes 10 minutes, after this time the reservation will be canceled automatically.
III Access to the Service
3.1 Full access to the SWRM Service is possible provided that the Client's computer system meets the following cumulative technical requirements:
• having an active e-mail account (email address), enabling contact with the Operator / SWRM Hotline,
• having access to a device enabling browsing of websites with an installed operating system enabling the operation of this device together with one of the Internet browsers installed: Mozilla FireFox, Microsoft Internet Explorer, Google Chrome, Opera, Safari.
• having an active connection to the Internet,
• having the acceptance of Cookie files ("cookies") in the Web browser used by the Customer,
• having in your client's Internet browser enabled Java Script scripting (enabled by default in your web browser),
3.2. The SWRM System Operator informs that it is also possible to use other operating systems and web browsers in the final device referred to above, however in such a situation, due to technological reasons, it can not ensure correct operation.
3.3. The operator also provides the latest version of the Mobile Application available for devices with the iOS and Android operating system. For the application to work properly, always install the latest available version.
IV. General conditions for using the SWRM System
4.1 The condition for using the SWRM System is the Customer's registration procedure at www.swrm.szczecinek.pl. The procedure consists in filling in the registration form and providing required, correct personal and contact details, accepting the provisions of the Regulations, conducting a correct verification of the e-mail address by clicking on the link received by email to the address provided during registration and making a non-returnable initial payment / deposit of PLN 19.
4.2. By accepting the Regulations, the Customer consents to the processing of personal data and to receive information materials to promote the SWRM System to the email address provided during registration. The Customer's personal data will be processed by the Operator only for purposes related to the functioning of the SWRM System.
4.3 The SWRM System Operator will issue the Client with a bike to use on the terms and conditions contained in the Regulations. The Customer undertakes to comply with the Regulations, in particular to pay the bike rental fee to the bank account indicated by the Operator, via an individual account in the SWRM System and to use the bike in accordance with its purpose.
4.4. The condition for using the SWRM System is that the Customer has in the Client's Account funds in the amount of at least PLN 10.00 (in words: ten zlotys 00/100), the amount being the right to rent one bike.
If you wish to acquire the right to rent two bikes, it is a prerequisite for the rental of two bikes that the Client has in the Client's Account funds in the amount of at least PLN 20.00 (in words: twenty zlotys 00/100). The User should also each time secure the amount he intends to use for journeys realized in the SWRM System
4.5. The customer bears full responsibility for the bike from the moment of its rental - removing it from the Station, until the bike is returned - connecting it to the Station and completing the return procedure, subject to point 4.6 of this section of the Regulations. Before using the bike, the customer should verify its technical condition (check the operation of brakes, lighting, tire pressure), and if it raises his doubts, put the bike in the nearest stand and contact the Infoline. The customer is responsible in particular for any damage caused by his fault, from the time of rental of a bike from any Station, until the moment of returning the bike, at any Station.
4.6 Minors who are under 18 years of age or other persons with limited legal capacity must provide the Operator with a written consent of their parents or other statutory representatives (legal guardians) before concluding the Agreement - to conclude the Agreement and a statement on the acceptance of the Regulations, take over by parents or other statutory representatives (legal guardians) of liability for any damages arising in particular due to non-performance or improper performance of the Agreement. A model statement is available on the website www.swrm.szczecinek.pl or www.rowery.szczecinek.pl (attachment No. 1). The signed statement must be delivered personally to the Operator or by sending it by registered mail to the address of the SWRM System Operator – Komunikacja Miejska Sp. z o.o. w Szczecinku
4.7. The Customer is obliged to immediately notify the Customer Service Office of the SWRM System about the theft of the bike made during the rental of the bike and immediately report this fact to the local Police unit.
The customer is responsible for the stealing of the rented bike and bears the financial responsibility in the event of its improper protection against theft during the rental, including, for example, unsecured bicycle with a safety code-locker.
4.8 The use of a rented bike is allowed in the city of Szczecinek in the area specified by the Operator of the SWRM System, presented on the website www.rowery.szczecinek.pl and in the mobile application SWRM
V Responsibility / Commitment of the Customer
5.1. The customer is responsible for using the bike in accordance with the terms of the Regulations and the provisions of the Polish Highway Code.
5.2. The customer undertakes to end the rental in a non-deteriorated condition from the condition in which the client rented a bike.
5.3. The customer undertakes to ensure that the bike is properly and effectively secured during the rental against theft and any damage, including securing the bicycle with a safety rope.
5.4. Making the bike or account available to a third party is an act contrary to the provisions of the Regulations and does not release the Customer from liability for damage or theft, until the end of the rental.
5.5. The Customer bears full responsibility for the consequences of events arising as a result of violation of the applicable law and the Regulations while using the SWRM System. The System Operator is not responsible for this.
5.6 It is forbidden to use the SWRM System by persons under the influence of alcohol or other intoxicants, psychotropic substances or substitute drugs within the meaning of the provisions on counteracting drug addiction, as well as drugs and substances whose use is a contraindication to driving vehicles.
5.7 The use of bicycles within the SWRM System may only take place for non-commercial purposes and only for the Customer's personal use.
5.8 In the event of damage / destruction of the SWRM System infrastructure (bikes, Terminals, Stations) resulting from improper use or breach of the provisions of the Regulations or the generally applicable law, the Client shall be obliged to cover all costs of repair and bring damaged / damaged infrastructure to the state before destruction / damage.
The Operator will issue a bill or a VAT invoice to the Customer for repairing the damaged / damaged SWRM System infrastructure.
5.9 Intentional damage to the infrastructure of the SWRM System will result in the System Operator submitting a criminal offense to the law enforcement authorities, arising on the side damaging the liability for damage / destruction, and the need for the perpetrator to incur any costs incurred as a result of the damage / destruction.
5.10. In cases of the Customer's fault, any possible damages resulting from non-performance or improper performance of the contract shall be borne by the SWRM System Client.
5.11 It is forbidden for the Customer to transport bicycles by any private mode of transport.
5.12 In the event of loss / damage / destruction of the bicycle by the Customer specified in the cases specified in point 4.7 or 5.8 of the Regulations, the total cost of replacement of the bicycle, as set out in the Table of Fees, is covered by the Customer.
5.13 The Customer is obliged to immediately cover all costs, penalties, fines and administrative fees imposed on him in connection with the use of the bike contrary to applicable law and the Regulations
5.14. Client's exceeding of the 12-hour bike rental period results in additional costs specified in the Table of Fees
5.15 In the case when an accident or collision occurs during the rental of the bike, the Client is obliged to write a statement or a summons to the place of the Police incident. The customer is obliged to inform the Customer Service Office about this fact immediately after the occurrence of such an event
VI. Registration and Rules for the processing of personal data
6.1. Customer registration in the SWRM System takes place at www.rowery.szczecinek.pl, www.swrm.szczecinek.pl or in the SWRM mobile application and is a prerequisite for using the SWRM System
6.2 The condition for registering the Customer in the SWRM System is to provide the following data
• E-mail address
6.3. The telephone number provided by the Customer during the registration process is used to rent bicycles at the terminal or mobile application.
The administrator of personal data is Komunikacja Miejska Spółka z o.o. w Szczecinku, ul. Cieślaka 6a, 78-400 Szczecinek NIP: 673-000-60-01 REGON: 330032817, IX Business Department in Koszalin, KRS: 0000025798, share capital: PLN 8.870.000 fully paid up.
6.4 In the case of questions regarding the protection of personal data, please contact us as follows:

• written contact, via traditional mail to the address of the KM headquarters in Szczecinek, ul. Cieślaka 6a, 78-400 Szczecinek
6.5. Personal data provided by the Customer are processed by the Operator of the SWRM System only for the needs of the System's operation, for the purpose of implementing the Agreement, considering complaints and in order to determine, assert or defend any claims.
6.6 The basis for the processing of the Customer's personal data by the Operator of the SWRM System is indispensable for the conclusion and performance of the contract between the SWRM System Operator and the Customer, which is concluded by accepting the SWRM System Regulations by the Customer, the obligation to fulfill legal obligations, and the legitimate interest pursued by the System Operator SWRM (in particular establishing, investigating or defending claims).
6.7 Recipients of Customers' personal data will be:
• Organizer of the SWRM System: Miejska Communications Sp. z o.o. in Szczecinek
• Comdrev Sp. z o.o. as a provider of ICT infrastructure
• Comdrev.pl Sp. z o.o. as a provider of software and mobile applications, e-mail, web hosting
• independent administrators - service providers supporting online payments (ie Przelewy24.pl with its registered office in Poznań) and by means of credit and debit cards,
• public entities authorized under the applicable law to receive personal data (eg police).
Personal data will be made available only when there is a legal basis for it. In the case of entities providing services to the SWRM System Operator (ie acting on its behalf and on its behalf), the Operator will conclude a data processing agreement and the data will be entrusted only to entities that guarantee an appropriate level of security of entrusted personal data.
The SWRM System Operator ensures that all its employees and associates who process their Customers' personal data have been authorized to do so, as well as obliged to keep all information confidential and confidential.
6.8. In connection with the processing of personal data, the Customer has the right to:
• request further information regarding the use of his personal data,
• request access to personal data and copy data that has been forwarded
• obtain in a structured, commonly used machine-readable format, personal data that has been provided to us and - if it is technically possible - request the transfer of such data to another administrator without hindrance if its processing is based on consent or contract and in an automated method,
• demand correction of any inaccuracies in the data we have,
• demand the deletion of any data for processing that KM no longer has legal grounds,
• to object to a given processing based on a legitimate interest for reasons related to a particular Client's situation, unless our processing bases are superior to the client's interests, rights and freedoms,
• demand a restriction of data processing, e.g. for the time the complaint is processed,
• file a complaint to the supervisory body - the President of the Office for the Protection of Personal Data.
The rights indicated above can be used by: (1) email contact at: email@example.com; (2) written contact, via traditional mail to the address of the Operator of the SWRM System.
6.9 The provided personal data and data collected on the basis of the Customer's activity (eg relationships) are not subject to any profiling activities, nor are they the basis for automated decision making.
6.10 Each Client who completed the registration procedure, after logging into the SWRM System, has access to all his data, has the possibility to update them in the SWRM System and access to transactions and loans for the duration of the Agreement.
6.11 Personal data will be processed by the Operator for as long as the Customer has an account in the SWRM System, it will be necessary to provide services or for the period of providing bike rental services to the System Organizer
VII Payment methods
7.1 The User pays a fee for using the SWRM System by making a donation to a dedicated prepaid account, i.e. a bank account created by the Operator to enable the Customer to use the SWRM System.
The payment to the prepaid account is made using the online payment portal and przelewy24.pl portal implemented on the website www.swrm.szczecinek.pl after the Customer has been logged in to his account in the SWRM System and the forms of payment available there.
7.2. The correct moment of payment shall be the moment when the funds are on the Client's prepaid account.
7.3. The funds paid into the Customer's Account are for use in the SWRM System and are not refundable during and after the termination of the contract except for the situation referred to in clause 12.3 of the Regulations.
VIII. Bike rental
8.1. The condition for renting a bike is to have an active account in the System and to have a positive balance on the Customer's Account, not less than PLN 10.00 gross (say ten 00/100).
It is also required for the User to have an active mobile phone allowing constant contact with the Customer Service Office of the SWRM System.
8.2. A bike can be rented at any SWRM Station after logging into the SWRM System with the telephone number provided during registration and following the messages displayed at the Terminal or in the mobile application.
8.3 The customer, before unhooking the selected bike from the Stojak, is obliged to make sure that the bike is useful for the agreed use. The customer should check in particular that the bicycle tires are inflated, the nuts on the wheels are twisted with adequate force, the chain is not too loose, brakes they are functional, whether the steering wheel is not too loose and whether it has a code fastened to the frame. In the event of improper bicycle condition, the Customer should immediately contact the SWRM System Service Office.
8.4. If any defect in the bike is detected, the Client is obliged to return the bike to the nearest Station and inform the Customer Service Office of the SWRM System about this fact giving the side number of the bicycle.
8.5. The bicycle is equipped with a basket placed on the front of the bicycle. The basket is equipped with an expander for fixing and securing the transported cargo. It is adapted to transport small items weighing less than 15 kg.
It is strictly forbidden to carry children in the basket.
Things heavier placed in the cart may be destroyed, for which the Operator is not responsible. It is forbidden to transport sharp objects protruding beyond the basket rim.
In the event of an accident or other incident arising as a result of improper use of the basket by the Customer, the Operator shall not be liable for any damage to items or goods carried in the basket.
8.6 The maximum load on a bicycle intended for use by one person may not exceed 90 kg.
8.7 The bike rented in the SWRM system should be used in accordance with its intended use. A bike that is a means of urban transport is used to move between stations
The bike is not intended for high-performance driving, driving off paved surfaces, racing or pushing or pulling any thing or person.
8.8 In case of any problems with renting a bike at a given Station, the Customer should immediately contact the Customer Service Office of the SWRM System. An Infoline employee will inform you about the solution that can be applied.
8.90 It is forbidden to use a security device, which is not a part of the SWRM System, to block a bike at the Station. If such security is detected, the Operator reserves the right to remove it, charging the Client with such costs in accordance with the Table of Fees.
8.10 It is forbidden to insert, and in particular to attach any other bikes to the Station, using any fastening. In the case of parking other bikes, they will be removed from the station with locks. The operator does not bear any responsibility for damaged bicycle locks not belonging to SWRM.
IX. The rental duration
9.1 The customer is obliged to return the bike at the latest by the twelfth hour of rental.
9.2 Exceeding the bike rental time results in the commencement of security measures and charges fees in accordance with the Table of Fees
9.3. Requirement indicated in point 9.1 does not apply to Special Action Customers
X. Bike return
10.1 The return of the bike can be done by the Customer in any Station by means of inserting the bicycle docking slot into the selected electro-lock placed in the Stand. The customer should make sure that the bike has been properly fastened by pulling the bicycle towards the user. The correct return will be signaled by a message displayed on the Terminal screen, a voice message and a push message sent to the telephone of the user with the SWRM application. It is not necessary to perform any other activities. The bike will be recognized in the SWRM System, automatically settled, and the fee due will be charged from the user's account to the Operator's account.
10.2 In the absence of free space on the Station (the station is overcrowded and there is no free slot with electrolock), the Client is obliged to return the bike using a safety rope, fastening the bicycle to the slot. In this case, the return of the bike is possible using the Terminal keypad located on the Bike Station and via the mobile application.
10.3 If the bike return procedure is incorrect due to the fault of the Customer, he is liable for any damage caused by the wrongful act to the Operator
XI Repairs and Failures
11.1. Any failures should be reported by phone to the SWRM System Customer Service Center at telephone number +48 94 712 88 88 and in the mobile application located in the main menu in the Report Failure tab. In the event of any failure that prevents further driving, the Customer must stop, notify the Customer Service Office of the SWRM System by phone and walk the bicycle to the nearest Station.
11.2. The customer undertakes to act in a way that limits the possibility of causing damage or liability for any reason due to improper use of the bicycle. The customer is obliged to have the possibility to contact the Customer Service Office of the SWRM System during the entire rental period.
11.3. It is forbidden to carry out any repairs, modifications or replacement of parts in a rented bike. The only authorized entity for these activities is the Operator Service of SWRM
12.1 The amount of the bike rental fee is defined in the Table of Fees available at www.rowery.szczecinek.pl, in the mobile application and at the Stations (Annex No. 2 to the Regulations). The fee is charged and collected according to the number of minutes of renting a bicycle, starting from the release of the lock in the rental process, ending at the end of the rental - the correct return of the bike to the Station.
12.2 Fees for using a bicycle depend on the length of the rental period.
12.3 If the fees due to the Operator for using the bike exceed the funds held on the User's Account, the User is obliged to bring the User's Account to the balance of at least PLN 0.00 within 7 days
13.1. Complaint is the Customer's notification via e-mail to the following address: firstname.lastname@example.org to request a refund of the fee for non-performance or improper performance of the Service.
13.2. The customer has the right to file a complaint within 7 days from the date of the event giving rise to the complaint. All complaints related to services provided on the basis of the subject Regulations should be submitted via e-mail to the Operator of the SWRM System to the e-mail address: email@example.com. Other forms of reporting complaints are not allowed.
13.3 A correctly sent complaint must be sent from the e-mail address provided during registration. In addition to the event described in detail, the complaint must contain the data of the Customer registered in the SWRM System, allowing unambiguous identification of the Customer. These data are:
• first name and last name,
• phone number (Login)
• e-mail address provided during registration
In the case of incomplete data, the Operator reserves the right to leave the complaint without recognition.
13.4. The SWRM System Operator will consider the submitted complaint within 14 days from the date of its submission or supplementation. In the case of completing the complaint, the deadline for considering the complaint begins to run from the date of delivery of supporting documents, additional explanations or information. Next, the customer will be sent feedback information to the e-mail address indicated during registration.
13.5. In the case of matters whose degree of difficulty prevents consideration in the abovementioned it is permissible to extend the time of consideration to 30 days, with prior information to the claimant about such necessity.
13.6. If the data or information provided in the complaint need to be supplemented, before proceeding with the complaint consideration, the SWRM System Operator asks the complainant to complete the necessary information.
13.7. Filing a complaint does not release the User from the obligation to timely fulfill his obligations to the SWRM System Operator and pay the due fee within 7 days of the event.
13.8. The Customer has the right to appeal against the decision issued by the Operator of the SWRM System within 14 days from its delivery to the Customer.
Appeals are considered within 21 days from the date of their receipt to the e-mail address: firstname.lastname@example.org
The customer has the right to submit an application to the Operator for reconsideration of a matter that is the subject of a decision issued as a result of a complaint.
13.9. The customer has the right to claim compensation for non-performance or improper performance of the service in court proceedings only when the complaint procedure is exhausted.
Complaint proceedings are considered exhausted also when the SWRM System Operator does not provide feedback on the submitted complaint within 1 month from the date of its submission. The operator is liable for non-performance or improper performance of the service in limitation to actual damage and does not take into account any lost benefits.
13.10. In the case of a positive complaint, the loans subject to the complaint are returned to the Client's Pre-paid Account on account of subsequent loans.
XIV. Withdrawal from the contract.
14.1 The User has the right to withdraw from the Agreement concluded with the Operator of the SWRM System, without submitting any further explanations, within 14 days from the date of its conclusion.
For this purpose, the User sends to the Operator's address: email@example.com a statement of withdrawal from the Agreement.
14.2 In the event of withdrawal from the Agreement by the Customer, if the balance of the Customer's Account is negative, the Customer is obliged to bring the balance 0.00 PLN (say zero zlotys), within 7 days from the date of withdrawal from the Agreement.
14.3 Financial resources paid into the Customer Account are subject to refund in the event of withdrawal from the Agreement by the Customer within 14 days from the date of its conclusion.
The above, however, does not apply to the situation in which, with the consent of the Customer, the service was completed before the deadline for withdrawal from the Agreement.
15.1 The Customer has the right to terminate the Agreement at any time. The termination of the Agreement should be sent in electronic form to the email address firstname.lastname@example.org along with the data enabling the identification of the customer entered when registering to the SWRM System, i.e.
•first name and last name,
• phone number (Login)
• email address provided during registration
• the bank account number to which the funds remaining on the Client's Account are to be refunded.
15.2 In the event of termination of the Agreement by the Customer, when the balance of the Customer's Account is negative, the Client is obliged to bring it to the balance of 0.00 PLN (in words zero zlotys), within 7 days from the date of the notice, regardless of the provisions of point 12.3 of the Regulations.
15.3 The Customer should use the prepayments made until the end of the contract. The operator does not refund paid but unused fees.
15.4 The Operator reserves the right to terminate the Agreement for important reasons, i.e. in the case of violation by the Customer of the provisions of the Regulations such as:
• failure to pay the fee for exceeding the 12-hour bike rental period,
• failure to pay for any damage to the infrastructure of the SWRM System,
• Failure to settle a negative account balance within 7 days, after previous unsuccessful calling of the Customer to cease or remove breaches.
XVI. Personal data
16.1 The administrator of the Customer's personal data is the SWRM System Operator
16.2. Customer's personal data will be processed by the Operator only for own purposes related to the functioning of the SWRM System
16.3. Your personal data is processed, stored and secured in accordance with the rules set out in applicable law.
16.4 The Operator undertakes to maintain the confidentiality of the Customer's personal data
16.5 The customer may, by separate statement, consent to the processing of his data for marketing purposes, sending commercial information, entrusting his data to third parties or for telephone contact for marketing purposes.
16.6. The customer has the right to access their personal data and request their completion, modification or deletion. In the event of any change in personal / contact details, the Customer undertakes to immediately update them in the SWRM System
XVII. Final Provisions.
17.1. Using the SWRM System requires:
• adequate health of the client, enabling safe use of the bicycle;
having skills and rights to use a bicycle;
• knowledge of traffic regulations, in particular the Road Traffic Act of June 20, 1997 (Journal of Laws No. 98, item 602, as amended).
17.2 The Operator reserves the right to change the provisions of the Regulations. Information about changes to the Regulations will be sent to the e-mail address provided by the Customer during registration in the SWRM System or to another e-mail address indicated by the Customer. The User may terminate the Agreement, however, the notice shall be sent to the Operator's office address. The lack of termination means the acceptance of the changes made to the Regulations by the Client
17.3 In the event of a breach of any of the provisions of the Regulations resulting in damage to the Operator, the Operator reserves the right to block the Customer's account in the SWRM System until the matter is resolved.
17.4 In matters not covered by the Regulations, the applicable provisions of law, in particular the Civil Code and the Road Traffic Law Act shall apply.

3. I undertake to cover all possible damages and claims arising in connection with the use of the abovementioned a minor from the SWRM System
4. I declare that the above the minor has a valid bicycle card or a driving license of the relevant category;
5. I agree to the processing of my personal data by the Operator and the above-mentioned a minor for the purposes necessary to use the System, in accordance with the requirements of the Act of 29 August 1997 on the Protection of Personal Data (Journal of Laws of 2002, No. 101, item 926), for the purpose of implementing the Agreement. I have the knowledge that I have the right to access the content of my personal data and the possibility of correcting, supplementing or changing it.
